Maria MÂNICUŢĂ Conducator ştiinţific- Prof. Dr. Ing. Aureliu LECA Abstract Lucrarea de faţă şi-a propus să acopere problematica liberalizarii sectorului energiei electrice, reflectând din perspectiva reglementatorului atât evoluţia pieţei de energie electrică din Romania din ultimii 15 ani de la monopol spre concurenţă cât şi provocările la care aceasta trebuie să facă faţă in viitorul apropiat. Capitolul 1 „Reglementarea pieţelor liberalizate de energie” tratează evoluţia istorică a organismelor de reglementare aparute ca o necesitate de a echilibra interesele industriei energetice organizată in sistem monopolist şi de a proteja consumatorul final de eventualele abuzuri ale unei puteri dominante. Odată cu liberalizarea relaţiilor comerciale in cadrul pieţelor de energie, reglementarea tradiţionala s-a metamorfozat concentrându-se în principal pe trei obiective: promovarea concurenţei la producere şi furnizare, protejarea intereselor consumatorilor, reglementarea activităţilor cu caracter de monopol natural - transport şi distribuţie, obiective esentiale reiterate şi în al treilea pachet de liberalizare a pieţelor de energie adopotat de UE in 2009. Capitolul 2 „Modele de funcţionare a pieţelor de energie” prezintă aspectele teoretice legate de funcţionarea unei pieţe concurenţiale eficiente şi robuste, scoţând în evidenţă factorii cei mai importanţi care contribuie la realzarea acestui deziderat: alegerea modelului de piaţă, cuplarea pieţelor cu livrare fizică cu cele financiare, eficacitatea monitorizării funcţionării acestora de către autorităţile de reglementare în colaborare cu cele din domeniul concurentei. Capitolul 3 „Analiza evoluţiei pieţelor de energie din România de la monopol spre concurenţă” se concentrează pe comparaţia proceselor de restructurare şi liberalizare a sectoarelor energiei electrice, respectiv gaze naturale arâtand progresele înregistrate în armonizarea relaţiilor de piaţa cu practicile europene aplicabile, dar şi deficientele care trebuie corectate. Capitolul 4 „Evaluarea impactului legislaţiei privind schimbările climatice asupra funcţionării pieţei liberalizate de energie electrică” prezintă abordarea schimbărilor climatice in cadrul UE (şi în paralel de România) care se focalizează pe limitarea emisiilor de gaze cu efect de seră, promovarea surselor de energie regenerabilă si îmbunătăţiri în domeniul eficienţei energetice. Capitolul 5”Integrarea energiei electrice produsă din surse regenerabile in piaţa liberalizată de energie –studiu de caz: România” prezinta detaliat experienţa românească privind stabilirea schemei suport pentru energia electrica produsa din surse regenerabile prin certificate verzi dezvoltă un model matematic de analiză cost-beneficiu a intensităţii sprijinului stabilit prin Legea220/2008 pentru proiectele investiţionale în acest domeniu. Capitolul 6 „Concluzii finale” sumarizează importanţa şi efectele activităţii de reglementare asupra funcţionării pieţelor liberalizate de energie, inclusiv elementele de contribuţie personală ale autoarei din teză. Considerations about the regulatory models impact on the functioning of the liberalized energy markets Doctoral Thesis (PhD Thesis) Author– eng. Maria MÂNICUŢĂ Scientific Coordinator - Prof. Aureliu LECA Abstract The paper aims to cover the issue of the electricity sector liberalization from the regulator's perspective on the evolution of the Romanian electricity market in the last 15 years from monopoly towards competition as well as of the challenges it must face in the near future. Chapter 1 ”Regulation of the liberalized energy markets” covers the hystorical evolution of the regulatory bodies established as a necessity to balance the interests of the monopoly-organized energy industry on the one hand and to protect the consumer of any abuse due to market power on the other hand. With the liberalization of trading relations in the energy markets, traditional regulation has metamorphosed focusing mainly on three objectives: promoting competition in generation and supply, protection of consumer interests, regulation of natural monopoly activities - transmission and distribution, key objectives that are reiterated in the Third Energy Package package that EU adopted in 2009. Chapter 2 „Energy market models” presents theoretical aspects related to the operation of an efficient and robust competitive market depending on numerous factors among which the most important are the design of the market model, the coupling of the physical delivery and financial markets, the effectiveness of the monitoring activity performed cooperatively by the regulators and the competition bodies. Chapter 3 „Analysis on evolution of the Romanian energy markets from monopoly towards competition” draws a comparison between the restructuring and the liberalization processes of the electricity and the natural gas sectors showing the progress achieved in the harmonization of the market relations with the applicable European practices and undelining the deficiencies that need to be corrected in the future. Chapter 4 „ Impact evalution of European climate changes legislation for the development and the functioning of the liberalized electricity markets” tackles the climate change issues concurrently in the EU and Romania with focuss on the mitigation of the greenhouse gases, promotion of renewable energy and energy efficiency improvement. Chapter 5 ”Integration of electricity from renewable energy sources into the liberalized energy market – case study: Romania” details the Romanian experience in setting up the green certificates support scheme for the use of electricity produced from renewable energy sources and develop a mathematic model for a cost-benefit analysis of the promotion scheme under the Law 220/2008. Chapter 6 „Final conclusions” summarizes the significance and impact of the regulatory activity upon the functioning of the liberalized energy market, including the original ingredients of the author’s contribution.
