Aureliu LECA Introduction of competition in energy sector had different reasons, starting with the avoidance of using energy resources as political weapon and ending with attracting private capital in investments in this sector of the economy. In European Union it was overlapped the desire to create a single internal market for all products, as an objective of the integration. Competitive markets are showing their limits when they are organized for fossil primary energy resources and for electricity due to their features, mainly: The growing imbalance between production and consumption of fossil energy resources; The need for simultaneous production of electricity according to consumption needs; Different production costs (both primary resources and electricity) in terms of a similar quality of goods. However, uncertainties in energy markets, including European Union regulatory risk characteristic, discourages investments with long recovery cycle. In these conditions, this thesis proposes a set of solutions targeted primarily to introduce or re-introduction of some regulated mechanisms in addition to competitive mechanisms, regulated mechanisms capable of correcting deficiencies arising from market volatility.
